GENERAL TERMS & CONDITONS

FOR

SALES, ENGAGEMENT AND LIAISON (SEAL) TEAMS

 

Singapore is a mature, compact, crowded, competitive and challenging market place, for almost any products and services, especially, for Kaspersky Lab, a "new kid in the block". Therefore having more than one SEAL Team (reseller/partner) competing in the market place to secure an account is a likely scenario. SEAL Teams should be using all their experiences, acumen, resources, etc., to be on top of any deal. In fact, these are the traits of the Navy SEAL Teams;  to dominate their opponents and achieve their mission.

In order to create a harmonious business environment and climate for SEAL Teams to promote and resell Kaspersky Lab Security products and services and ObserveIT solution, Byteworks shall require ALL its SEAL Teams to comply with these Terms & Conditions. These Terms & Conditions are designed to achieve the following objectives:

  • Ensure and Enhance End Users' Trust and Satisfaction
  • Encourage SEAL Teams' Enhancement of Customer Relationship
  • Preserve the SEAL Teams' investment and resources committed to secure Leads and maintaining Accounts 
  • Minimise Misunderstandings & Conflicts
  • Enhance Productivity

KASPERSKY LAB SEAL TEAMS

Price List & Quotation

1.     Respective Account Manager will provide SEAL Teams with product/service (s)details, quotation or other advice when requested by the SEAL Team. Price List is published in Byteworks' web site but it is opened only to selected active SEAL Teams for confidentiality reason.

Special Price Request

2.     In order to be competitive, SEAL Teams may be offered Special Price which is well below the published price in the Price List. For this, SEAL Team is expected to provide competitor's pricing, competitor's quote, etc., to justify for such Special Price.

 Crossgrade/Competitive Upgrade

 3.     To qualify for such pricing, existing competitor's AV softcopy license of equivalent type and quantity have to be furnished for verification by Kaspersky Lab without demand, prior to our quotation.

 SEAL Team Discounts

4.     Standard

  • SEAL Team STANDARD discount shall be multi-tiered, viz., SILVER, GOLD and PLATINUM. All SEAL Teams shall commenced with a standard SILVER discount which ranges from 15% - 20%, depending upon company size, company ACRA registration (e.g., LLP, Pte Ltd, Limited), payment terms, volume of sales, technical support capability, etc. This is reviewed 6 monthly or upon request.
  • The percentage point of GOLD and PLATINUM will depend upon the SEAL Team's SILVER discount. GOLD will be 5 percentage points and PLATINUM will be 15 percentage points above the standard SILVER discount. Example; with a 15% SILVER discount, the GOLD discount shall be 20% and PLATINUM, 30%; with a 20% SILVER discount, the GOLD discount shall be 25% and PLATINUM, 35%.

5.     Non-Incumbent

  • SEAL Teams will enjoy STANDARD discount for all Add On or Renewal licenses purchased for their existing accounts. Upon request, Add On or Renewal licenses for existing accounts may be offered to non-incumbent SEAL Teams at a flat SEAL Team discount of 10%
  • Upon request, licenses(s) for leads with incumbent SEAL Team, may be offered to non-incumbent SEAL Teams at discount of 10%.
  • Public Base or Renewal Licenses specified in public (government) tender or belonging to government entities have no incumbent SEAL Teams. Unless assigned by Byteworks (Article 6), prevailing STANDARD discount shall apply to ALL such accounts.

Accounts/Leads Assignment

6.     Byteworks' Assigned Leads or Special Price Accounts

  • These will be offered to ANY SEAL Team at a discount of 5% below the respective SEAL Team prevailing STANDARD discount.

7.     Incumbent SEAL Team's Accounts

  • Registered Leads or Existing Accounts shall lose their incumbent status once they expired. For registered leads, this is sixty (60) days after registration. For Renewal licenses, this is thirty (30) days from expiry date stipulated in the Kaspersky Lab softcopy license delivered, via email, by Byteworks.
  • All such "released" accounts shall be reclassified as Byteworks' Leads and may be offered to any SEAL Team at the discretions of the Account Managers.

Order Processing & License Delivery

8.     All orders will be processed upon receipt of the order submitted online. The account Manager will deliver the license to the SEAL Team within 4 (four) working days, depending upon payment terms offered to the SEAL Teams or specified in the SEAL Team Code whichever is available.

First Level Technical Support

9.     SEAL Teams are expected to maintain post sales technical staff to provide first level support to their end users. In this regard, SEAL Teams members are encouraged to undergo the online Sales & Technical training modules provided by Kaspersky Lab, to better prepare themselves to adequately serve their End Users. At times, such training will be onsite and offered to SEAL Teams' members. In additional to undergoing training, SEAL Teams' technical members are strongly encourage to obtain certification by Kaspersky Lab.

Byteworks' Rights & Liabilities

10.    Byteworks ' Management reserves the right to amend/revise these Terms and Conditions at its discretion without prior notice or consultation with any 3rd party. SEAL Teams are encouraged to check this site for updates and to ensure compliance.

11.   Byteworks' Management shall not be liable for any loss of money, assets, resources, goodwill or whatsoever, as a consequence of its revision of these Terms and Conditions.

 

OBSERVEIT SEAL TEAMS

Price List & Quotation

1.     Respective Account Manager will provide SEAL Teams with product/service (s) details, quotation or other advice when requested by SEAL Team. Price List of ObserveIT is not published in Byteworks' web site.

Special Price Request

2.     In order to be competitive, SEAL Teams may be offered Special Price which is well below the initial price quoted. For this, SEAL Team is expected to provide competitor's pricing, competitor's quote, etc., to justify for such Special Price.

SEAL Team Discounts

3.     Standard

  • SEAL Team STANDARD discount varies from company to company. It ranges from 15% - 20%, depending upon company size, company ACRA registration (e.g., LLP, Pte Ltd, Limited), payment terms, volume of sales, potential technical support capability, etc. This is reviewed annually, if necessary.

4.      Non-Incumbent

  • SEAL Teams will enjoy STANDARD discount for all Add On or Maintenance licenses purchased for their existing accounts. Upon request, Add On or Maintenance licenses for existing accounts may be offered to non-incumbent SEAL Teams at a flat SEAL Team discount of 10%.

  • Upon request, licenses(s) for leads with incumbent SEAL Team, may be offered to non-incumbent SEAL Teams at discount of 10%.

  • New or Maintenance Licenses specified in public tender or belonging to government entities have no incumbent SEAL Teams. Unless assigned by Byteworks (Article 5), STANDARD discount applies to ALL such accounts.
